About these terms

These Terms and Conditions apply to services and products provided through this website by MiguelMateas Ltd, including consultations, courses, masterclasses, digital materials and other educational activities.

Separate Online Learning, Membership and Community Terms apply to The Circle, recorded masterclasses and other participatory online learning.

By making a booking or purchase, you agree to the terms applicable to that service or product.

Appointment bookings

Appointments may be booked through this website or arranged directly. You will receive confirmation by email with the date, time and joining information.

Fees are payable in advance unless another arrangement has been agreed in writing.

Where a deposit is required, it is not normally refundable but may be transferred to another appointment where sufficient notice is provided. This does not affect your statutory rights.

Appointment cancellation and rescheduling

Please provide at least 48 hours’ notice if you need to cancel or reschedule.

Cancellations made between 24 and 48 hours before an appointment may be rescheduled once, subject to availability. Cancellations made with less than 24 hours’ notice will incur a charge of 50% of the consultation fee. Failure to attend without notice will incur the full fee.

If you arrive late, I will make reasonable efforts to accommodate you, but the consultation may need to be shortened to avoid affecting other clients. The original fee will continue to apply.

If I need to cancel, you will be offered a new date or a refund of the amount paid.

Courses and masterclasses

Full payment is normally required to secure a place on a course or masterclass. The relevant sales page will explain what is included, whether the activity takes place live and whether a recording or additional materials will be provided.

If you cannot attend live, your entitlement to a recording, transfer or refund will depend on what was stated when you purchased. A transfer may be offered in exceptional circumstances, subject to availability.

If MiguelMateas Ltd cancels and cannot provide a suitable alternative, you will be offered a transfer or a refund of the amount paid.

Live and recorded masterclasses are also governed by the separate Online Learning, Membership and Community Terms, including information about recordings, Q&A contributions, privacy and permitted use of materials.

The Circle and online learning

Masterclasses, Circle membership, Circle Gatherings and other participatory online learning are subject to the separate Online Learning, Membership and Community Terms.

Those terms explain:

  • Recurring membership payments and cancellation.

  • Access to materials and recordings.

  • Recording of live activities.

  • Questions, comments and member contributions.

  • Community conduct and confidentiality.

  • Intellectual property and permitted use.

They should be read before purchasing or participating.

Consumer cancellation rights

Nothing in these terms affects your statutory consumer rights.

When purchasing online, you may have a legal right to cancel within 14 days. If you expressly request that a service begins during this period, you may be charged a proportionate amount for anything already provided.

Where digital content is supplied immediately, you may be asked to agree to immediate access and acknowledge how this affects your cancellation rights. The applicable information will be provided before purchase or access begins.

Outside any applicable statutory cancellation period, fees and digital purchases are not normally refundable or transferable except as stated in these terms or where required by law.

Professional status and scope

Dr Miguel Toribio-Mateas is a Chartered Biologist (CBiol) and Member of the Royal Society of Biology (MRSB).

Services are provided within his qualifications, professional experience and stated scope. Chartered Biologist status is a professional recognition of competence in biology; it does not make these services medical diagnosis, treatment, psychotherapy or emergency healthcare.

Educational and medical disclaimer

Information provided through the website, consultations, courses, masterclasses, The Circle, digital resources, newsletters and social media is intended for education, reflection and general wellbeing support.

It is not a substitute for individual medical advice, diagnosis, psychological therapy or treatment from an appropriately qualified healthcare professional.

Always consult your GP, pharmacist or another qualified professional before making significant dietary or supplement changes, particularly if you have a medical condition, take medication, are pregnant or are receiving treatment.

No particular result or outcome can be guaranteed.

Consultation recording and note-taking

To support accurate records and as a reasonable adjustment, I may use Zoom Notes, a third-party note-taking service, to record and transcribe the audio of online consultations.

I will explain this and ask for your explicit agreement before recording begins. If you prefer not to be recorded, alternative note-taking arrangements will be used without affecting your consultation.

Audio recordings are normally deleted after the transcript has been checked and within 30 days. Relevant notes or transcript content may form part of your confidential consultation record and be retained as described in the Privacy Notice.

Confidentiality

Information shared during an individual consultation is treated confidentially.

It may be disclosed or processed only:

  • With your permission.

  • By contracted service providers where necessary to deliver the service.

  • Where required by law.

  • Where reasonably necessary for safeguarding or protecting someone from serious harm.

  • For establishing, exercising or defending legal claims.

Intellectual property

Unless stated otherwise, website content, recordings, slides, frameworks, guides, workbooks and other resources are owned by MiguelMateas Ltd, Dr Miguel Toribio-Mateas or the credited creator.

Materials are provided for personal learning and professional reflection. They must not be copied, adapted, published, distributed, uploaded elsewhere, taught, sold or incorporated into commercial products or services without written permission.

Purchasing or attending a service does not provide certification, accreditation or a licence to reproduce or commercially deliver PHOCUS, the Four-Signal Map or another proprietary tool.

Website and third-party services

Reasonable care is taken to keep information accurate and services accessible, but uninterrupted availability cannot be guaranteed.

Some services are delivered using third-party platforms such as Squarespace, payment providers, Zoom, email services, FastComments and transcription or note-taking providers. Their availability may occasionally be outside the control of MiguelMateas Ltd.

Links to external websites are provided for convenience and do not imply responsibility for their content or privacy practices.

Limitation of liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or for death or personal injury caused by negligence.

Subject to that limitation, MiguelMateas Ltd is not responsible for indirect or consequential losses arising from reliance on general educational information, interruption of a third-party platform or use of materials outside their stated purpose.

Privacy and data protection

MiguelMateas Ltd is the data controller and is registered with the Information Commissioner’s Office under registration number Z3481841.

Personal information is processed in accordance with the UK GDPR and Data Protection Act 2018. Please read the separate Privacy Policy for information about what is collected, why it is used, who may process it, how long it is retained and your rights.

Questions and complaints

You may also raise a data-protection concern with the Information Commissioner’s Office at ico.org.uk.

Changes to these terms

These terms may be updated when services, working practices or legal requirements change.

Material changes affecting existing clients, purchasers or members will be communicated where reasonably possible. Changes will not retrospectively remove statutory rights attached to an existing purchase.

Governing law

These terms are governed by the laws of England and Wales. This does not affect any mandatory consumer rights that apply where you live.
